What are some disadvantages to Restricted Reporting?

  • No investigation
  • Nothing will happen to the accused
  • Accused will remain in a position to likely sexually assault others
  • Military Protective Orders are not available to victim
  • Separating the Victim from the Accused is not available
  • Will not be able to discuss with anyone else or it would then void protection offered under restricted reporting

Are there any excepting to restricted reporting?

  • If a victim consents in writing to allow information to be disclosed to commander/law enforcement
  • Command and Law Enforcement will be notified in cases whenever there is a serious or imminent threat
  • Disability Boards will receive certain information to determine fitness for duty or retirement disability
  • SARC, VA and Healthcare providers can share information among each other as needed to facilitate supervision/coordination of victim services and treatment
  • Military and civilian courts or judges may order release of information (e.g., cases of mandatory reporting for child abuse or domestic violence).
  • You can change your reporting to unrestricted if you change your mind
  • You cannot go back to Restricted after you select Unrestricted

Why would an investigation of a Restricted Report happen?

  • Commander receives information from a source independent of the restricted reporting avenue
  • Victim discloses circumstances of the sexual assault to someone other than the VA, SARC, Chaplain, or Healthcare provider

Would the SARC, VA or healthcare provider disclose during an investigation?

  • The only way is if the victim authorized the disclosure in writing
  • Or another exception applies
  • Disclosure will be limited to that necessary to satisfy the purpose of the disclosure.
  • Further disclosure will not be made unless the victim authorizes the disclosure in writing

Why do I have to sign the Victim Reporting Preference Statement?

  • A tool available to help both the VA and the victim begin to focus on the reporting options available to the victim
  • Show the implications associated with each of them
  • Mandatory DoD form that all victims will be required to sign when presenting for treatment of a sexual assault
  • The VA is responsible for going over and explaining each item on the form
  • Victim will be provided a copy of the form
  • If victim refuses to sign it could result in an automatic unrestricted report
  • A refusal would notify the command and the criminal investigative organization

What should I do if I am sexually assaulted?

  • Go to a safe location away from the attacker
  • If you need immediate medical treatment dial 911
  • If you are in life threatening danger dial 911
  • Call a SARC immediately
  • If you don't know who your SARC use the Resource Finder
  • If your State SARC is not available contact the NGB Hotline- 866-601-0577
  • Call Military One Source Conus -800-342-9647 (Tell them you are National Guard)
  • Call Military One Source OConus – 484-530-5908 (COLLECT)
  • Preserve the evidence
    • Do not change your clothes or shower (could be used for evidence)
    • Do not clean the room or assault site
    • Do not eat, drink or brush your teeth
    • Do not urinate
  • Seek medical attention if necessary
  • Even if you do not have any visible physical injuries, you may be at risk of becoming pregnant or acquiring a sexually transmitted disease.
  • Go to a medical treatment facility and ask for a SANE Nurse (specifically for sexual assault)
  • Have a sexual assault forensic exam (safe) done (evidence against subject)
  • If you suspect you had been drugged, request that a urine sample be collected.
  • Ask for a Victim Advocate (can be assigned from different unit or service)
  • If you are Deployed as for a SARC or VA at the nearest clinic
  •

  • Privileged communications
  • Not allowed entitlement of restricted reporting
  • They will not breech covered communications
  • If Victim wants restricted/unrestricted case they must then speak with a SARC

  • HCP will not breech confidentiality with patients
  • HCP will report an incident that has occurred to the SARC
  • If the victim wants a restricted or unrestricted case they must speak with a SARC
